Report them to USCIS and blacklist them. They don't get anything by suing you. They have more to lose if you report them to USCIS.

I was thinking I was all alone until my friend sent me the link to this forum to find out that there are so many others in a situation like me. Employer not filing I485 because of so many stupid excuses. Emails/Voicemails go in vaccum these days.

it says nothing about who can file an application.
it only says the "status may be adjusted" IF.....
I-485 application is nothing but application to "adjust the status". Section 245 govern the area of I-485 filing and approval (or denial).
Also, read (3) again in previous post
an immigrant visa is immediately available to him at the time his application is filed.
Do you know that "his application" means here. Right, it is I-485 application.

I hear ya and feel for you Nag. That is why I posted a thread inquiring about ability to file for AOS/benefits after I-140 even when PD is not current. I believe this is an achievable administrative fix, however with almost everyone applying in July/Aug, this may be on the back burner in the foreseeable future.

My husband also got welcome e-mail mentioning about ADIT processing but when he received his card there was no information regarding ADIT processing, should we do anything about it? We have no clue, please help!!!

on 8/16 - Current Status: Notice mailed welcoming the new permanent resident. On August 16, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

This is for my wife's first time EAD.

Priority Date: June 20, 2006
I-485 filing date: July 17th, 2007
Paper based EAD application Received date: Aug 8th, 2008
LUD : Aug 12th, 2008
Card Production Ordered : Aug 16th, 2008
Card Received by mail : Aug 21st,2008 ( valid for 2 years)
Whole process took around 2 weeks.
Congratulation. That was quick. I applied for EAD renewal for me and my wife RD 7/9/2008 and still waiting.

- Flew into YYZ (with family), completed landing process last week
- Have expired H1-B stamp but approved I-797s
- Flew back this week on AVR
- No questions asked on both sides
- Stayed in Canada for a week. Its an amazing country with mix of good points from Europe (relaxed life, warm people ...) and USA (cleanliness, immigrant friendly ...) and a stable economy (atleast this far...). Overall, liked Canada alot
- Some people say, "its sheer luck", but many friends have done this without any problem. I would say "its sheer bad-luck" if anyone got into trouble doing this
- I would not suggest giving up the Canadian PR based on just rumors and no facts
- Have pending 140 and 485
- Have APs too, but did not use them

This is not a personal advice but general appeal to all would be employers.
I hope you have researched and understood obligations of an employer.
By virtue of owning the business and taking 100% of returns, the employer has to assume 100% risk.
If not on revenue sharing with employee ( 80-20 etc) , the employer has no business of NOT paying on bench. Either the employee is on rolls or has to be advised to take LOA or let go.
For other unprofessional tactics, there is simply no excuse. Employment is at will. If employers cant deal with that, too bad. They should not be starting the business.
I have worked with Desi employers who have consistently run on best practices and completely adhering to law of the land. It can be done and the cost of doing that has to be factored into the business plan. If it is too costly as per your financial numbers, then you are not ready for it financially.
There is moral obligation too. Whenever you hire H-1s make sure most of them have dreams to get GC and settle down. Dont take risks in such a ways their dreams get shattered because of poor business practices. just to hire people dont run in your businesses on losses and in turn force yourself to shut down the business.

i think this walk should be postponed out to atleast a week or two away.
Firstly i live in Santa clara myself and i had no clue about this till now (less than 24 hours away)
If we organize this the right way you can get atleast a few hundreds of people.
Wait till July 10th, see if we get media coverage with the whole gandhigiri idea.
Organize this and publicize.. start email chains .. for example cisco/oracle etc have lots of H1bs.
hang placards with the number of years you have waited/you educational qualification/ SSN tax and other taxes paid...
make a single file.. and walk about 2 miles without any slogans.
get the media to cover this event appropriately.
